Terms of Service

These Terms are a binding agreement between you and Wicked RC LLC ("we", "us"), a Massachusetts limited liability company at 68 Tadmuck Road, Westford, MA 01886, which runs zirtola.com, the Zirtola Launcher and the games we publish under the name Zirtola Developers (together, the "Services"). By creating an account or using the Services you agree to these Terms and to our Privacy Policy and Refund Policy.

1. Who can use the Services

You must be at least 13 years old. If you are under 18, you confirm that a parent or legal guardian has read and agreed to these Terms on your behalf. You may not use the Services if you are barred from doing so under the laws that apply to you.

2. Your account

You need an account to post in the community, send messages, buy games and use the launcher. Give accurate information, keep your password secret, and tell us promptly if you think someone else has used your account. You are responsible for everything done through your account. One person per account; accounts may not be sold or transferred.

3. Community rules

You are responsible for what you post, including forum threads, replies, comments, direct messages, chat messages, poll answers, profile details and images. Do not post anything that:

• harasses, threatens or attacks anyone, or contains hate speech or slurs;
• is sexual, graphic, violent or otherwise not safe for work;
• is spam, advertising beyond reasonable self-promotion, or misleading;
• infringes someone else's copyright, trademark, privacy or other rights;
• shares builds, keys or information you were given privately, such as early access material;
• contains malware or tries to break, overload or get around the security of the Services.

We use automated filters and human moderators. We may edit, hide or remove content and suspend or close accounts that break these rules, at our discretion and without notice. Our community rules explain this in everyday language.

4. Content you post

You keep ownership of what you post. You give Wicked RC LLC a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example resizing images) and distribute it in connection with running and promoting the Services. This licence ends when you delete the content or your account, except for copies others have already quoted or shared, backups kept for a limited time, and content we must keep by law.

If you send us ideas or feedback about the games, we may use them freely without paying you or crediting you.

5. Buying games

When you buy a game you get a personal, non-exclusive, non-transferable, revocable licence to install and play it on Windows through the Zirtola Launcher, for your own non-commercial use. You are buying a licence, not the game itself.

• One PC at a time. Each licence plays on one computer at a time. You can move it to another PC by deactivating the old one in the launcher or in your account settings. If you switch more than 3 times in 30 days, our support team will move it for you.
• Online check. Games check your licence when they start. They keep working offline for up to 7 days after the last successful check, then need to go online once.
• Updates. Every update to the base game is included. Some especially detailed machines or features may later be sold as optional add-ons; we will say clearly what is included before you buy.
• Game keys. A key can be redeemed once, onto one account. Keys may not be resold or shared; we may revoke keys that are.
• Prices and payment. Prices are shown in US dollars. Payment is handled by Stripe; we never see or store your full card details. Sales tax or VAT is shown at checkout where it applies.
• Refunds. See our Refund Policy.

We may revoke a licence that was bought with a payment that is reversed, charged back or fraudulent, or that is used in breach of these Terms.

6. Early access

Games marked "early access" are still being made. They may contain bugs, change significantly, lose features, or occasionally require starting a new save. We plan to keep developing them but cannot promise a finished release date or any particular feature. Buy an early access game for what it is today.

7. The Zirtola Launcher

The launcher installs, updates and starts our games and keeps them up to date automatically. To work it records which PCs you play on, how long you play, and the career stats the games report. With your permission it also sends hardware information and crash reports. Our Privacy Policy explains this in detail.

8. Rules for using the software

Unless the law allows it despite this restriction, you may not: copy, sell, rent or share the games or launcher; reverse engineer, decompile or modify them; get around licence checks or activation limits; cheat in or exploit bugs in shared or multiplayer sessions; or use bots, scrapers or automated tools on the Services.

9. Donations

Donations to support the studio are voluntary gifts. They do not buy any product, licence or service, and are not refundable except where the law requires. Donations are not tax-deductible.

10. Our intellectual property

The Services, games, launcher, artwork, videos, logos and the names Zirtola and Zirtola Developers belong to Wicked RC LLC or its licensors. These Terms do not give you any right to use them except as described here. Section 15a explains how you can use our games in videos, streams and reviews.

11. Copyright complaints

If you believe content on the Services infringes your copyright, send a notice to accounts@wickedremotecontrol.com or by post to the address above with: your contact details, the work you claim is infringed, where the material appears on the Services, a statement that you believe in good faith the use is not authorised, a statement that the notice is accurate, and your signature. We remove infringing material and close the accounts of repeat infringers.

12. Ending your account

You can delete your account at any time from Settings. Deleting it removes your profile, posts and messages and ends access to games you own through it. We may suspend or close your account if you break these Terms, if required by law, or to protect other users or the Services. Sections 4, 8, 10 and 13 to 16 continue after your account ends.

13. Disclaimers

The Services, games and launcher are provided "as is" and "as available". To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the Services will be uninterrupted, secure or free of errors, or that content posted by other users is accurate.

14. Limitation of liability

To the fullest extent allowed by law, Wicked RC LLC and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Some places do not allow these limits, so they may not apply to you.

15. Indemnity

If a third party brings a claim against Wicked RC LLC because of content you posted on our Services that broke the law or these Terms, or because you misused the Services, you agree to cover our reasonable costs of that claim, including reasonable legal fees. This does not apply to honest reviews, opinions or criticism of our games or company, wherever you publish them.

15a. Videos, streams and reviews

You're welcome to make videos, livestreams, screenshots and reviews of our games and share them anywhere, including on monetised channels such as YouTube and Twitch. You don't need to ask us first.

• Say what you think. Positive or negative, honest opinions and criticism are welcome. We will never use these Terms, or any claim, against you for an honest review.
• It's yours. You own the videos and streams you make. You may show gameplay with its in-game audio, and our trailers and screenshots, as part of your content.
• Monetise freely. You may earn from ads, sponsorships, memberships and donations on content featuring our games.
• Just be clear. Don't present yourself as working for us, or your content as made or sponsored by us, unless it is. If we gave you a free copy or you are in our affiliate program, disclose it the way your platform and local law require.
• Leaks. Please don't publish early access builds, keys or information we shared with you privately until we say it's public.

16. Disputes and governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. Any dispute will be heard in the state or federal courts located in Middlesex County, Massachusetts, and you and we consent to their jurisdiction. Nothing here takes away rights you have under consumer protection laws where you live.

17. Changes to these Terms

We may update these Terms. For significant changes we will notify you by email or on the site at least 14 days before they take effect. If you keep using the Services after that, you accept the new Terms; if you do not agree, you can close your account.

18. Other terms

These Terms, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, sale or reorganisation.
